How the Juvenile System Works in Florida

Florida’s juvenile justice system is governed by Chapter 985, Fla. Stat. The system is designed to balance public safety with rehabilitation, and it operates separately from the adult criminal courts. Cases are handled through the Department of Juvenile Justice and the circuit court’s juvenile

When a juvenile is taken into custody, the process moves quickly. A detention decision is made within 24 hours, and a detention hearing must be held promptly. From there, the case may be handled through a diversion program, a consent agreement, or a formal delinquency petition filed with the court.

If a petition is filed, the case proceeds to an adjudicatory hearing, which functions similarly to a bench trial. There is no jury. The judge decides whether the juvenile committed the alleged act. If the child is adjudicated delinquent, the court proceeds to a disposition hearing to determine the appropriate consequence.

Transfer to Adult Court

This is one of the most critical issues in juvenile defense. Florida law provides mechanisms for transferring a juvenile to adult court, where the full range of adult criminal penalties applies. Transfer can occur voluntarily, through prosecutorial direct file, or through a judicial transfer hearing. Certain serious offenses carry a presumption in favor of adult prosecution.

If a case is transferred to adult court and a conviction follows, the child faces adult sentencing, an adult criminal record, and all of the collateral consequences that come with it. Preventing transfer, or challenging a transfer decision, is often the most important fight in a juvenile case.

Possible Dispositions

The range of dispositions available to the court is broad. Depending on the offense, the child’s history, and the circumstances of the case, the court may impose civil citations, diversion programs, probation, community service, restitution, placement in a residential program, or commitment to the Department of Juvenile Justice at varying levels of restrictiveness. The goal of the system is to use the least restrictive option appropriate to the situation, though serious or repeat offenses can result in more severe placements.

The juvenile system offers options that the adult system does not. Diversion programs, civil citations, and consent agreements can resolve cases without a formal adjudication, which helps preserve the child’s record. Those options are most available early in the process, before a petition is filed and before positions become entrenched.
