Organized Fraud and Communications Fraud under § 817.034, Fla. Stat., known as the Florida Communications Fraud Act, covers systematic schemes to defraud. Organized fraud, where a person engages in a scheme and obtains property, is classified based on the aggregate value taken. Property with an aggregate value of $50,000 or more is a first-degree felony. Between $20,000 and $50,000 is a second-degree felony. Under $20,000 is a third-degree felony. Importantly, amounts from multiple victims or multiple acts within a single scheme are aggregated for purposes of charging and sentencing, and each individual communication made in furtherance of a scheme can be charged as a separate count of communications fraud.
Identity Theft under § 817.568, Fla. Stat., criminalizes the unauthorized use of another person’s personal identification information for any benefit.
